The Difference Between Hemp Derived and Marijuana Derived THC

With the legalization of hemp through the 2018 Farm Bill, CBD has become an all the rage wellness product. What’s less talked about however is that the same legislation inadvertently legalized some forms of THC as well.

 

Is THC Legal?

 

The legislation itself states that hemp is defined as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis”.  However, delta-9 tetrahydrocannabinol is not the only kind of psychoactive THC that exists. There are also other types of THC as well such as 11-hydroxy-THC, which is present in low amounts in cannabis, but high concentrations are found in the human body, as well as delta-8 tetrahydrocannabinol, which is found in small concentrations in the male cannabis plant – also known as hemp.

 

Delta-8 tetrahydrocannabinol, often more commonly known as Delta 8, is as such not a controlled substance under the Controlled Substances Act and is not regulated by the FDA. It remains legal in the majority of US states including Maryland. So long as a substance contains less than 0.3% by dry weight delta-9 tetrahydrocannabinol, it remains completely legal.

 

Difference between Delta-8 vs. Delta-9 Products

 

Delta 8 is extracted through the hemp plant using a chemical process. Because it is not as commonly found, it undergoes a more labor and time. It is then further refined, and placed within a consumable product, most commonly in the form of gummies and other edibles. While Delta 8 is commonly cited as being less intense, the ultimate difference between the two of them besides production is one of legality. Delta 8 has been decriminalized on the federal level, whereas Delta 9 remains a Schedule 1 controlled substance, considered as having no recognized medical value and on par with other drugs like heroin.
